400;\"><strong>Underpayment, or wage theft, is when a boss doesn\u2019t pay you what you\u2019re owed.<\/strong> You can\u2019t always rely on your boss to pay you properly \u2013 you need to check for yourself. As union members, we work together to enforce our rights to fair pay. Wage theft can occur in a variety of ways, including:<\/p><ul><li>Paying hourly rates below the modern award minimum rates, below the rates in an applicable enterprise agreement, or below the national minimum wage<\/li><li>Misclassifying workers on a lesser pay rate<\/li><li>Failing to pay overtime or penalty rates, allowances or other loadings<\/li><li>Making unlawful cash deductions from wages<\/li><li>Enforcing illegal cash-back schemes<\/li><li>Not receiving superannuation, or the wrong amount of superannuation<\/li><li>Not accruing leave entitlements like personal\/carer\u2019s leave or annual leave<\/li><li>Receiving a flat rate for all hours worked, which doesn\u2019t properly compensate for other entitlements that would otherwise apply<\/li><li>Not being paid for attending training at the direction of your employer<\/li><li>Working excessive hours on a salary<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1ac9a9d elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1ac9a9d\" data-element_type=\"section\" data-e-type=\"section\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-extended\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-ac6048b sc_inner_width_none sc_content_align_inherit sc_layouts_column_icons_position_left\" data-id=\"ac6048b\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-50d495c sc_fly_static elementor-widget elementor-widget-text-editor\" data-id=\"50d495c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4>Work out if you\u2019re being underpaid<\/h4><p>First you need to determine your rate of pay. You can find this in your\u00a0<a title=\"https:\/\/services.fairwork.gov.au\/find-my-award\" href=\"https:\/\/services.fairwork.gov.au\/find-my-award\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">modern award\u00a0<\/a>or\u00a0<a title=\"https:\/\/www.fwc.gov.au\/agreements-awards\/enterprise-agreements\/find-enterprise-agreement\" href=\"https:\/\/www.fwc.gov.au\/agreements-awards\/enterprise-agreements\/find-enterprise-agreement\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">enterprise agreement<\/a>\u00a0on\u00a0<a title=\"https:\/\/www.fwc.gov.au\/agreements-and-awards\" href=\"https:\/\/www.fwc.gov.au\/agreements-and-awards\" target=\"_blank\" rel=\"noopener noreferrer nofollow\">the Fair Work Commission website<\/a>. If you don\u2019t have these, we can help you to get them from your employer.<\/li><li>A record of the hours you worked when you were underpaid, including the dates, start times, finish times and any breaks taken during your shifts. Keep your own diary of your hours if they don\u2019t match with your payslip. It\u2019s likely that you\u2019re not the only one.<\/li><li>Together, you can bring your concerns to your boss. This could be in a joint meeting or through a letter signed by all of you. No one has to do this alone.
